These terms are a working launch draft for the app and website. They should be reviewed by counsel before publication, especially for governing law, property-management contracts, payment terms, and local compliance requirements.
Acceptance
These Terms of Service ("Terms") are an agreement between you and Mountain Estates Property Management ("Mountain Estates," "we," "us," or "our"). By accessing or using mountainestatespm.com, account.mountainestatespm.com, the Mountain Estates PM application, invite links, account links, email updates, support channels, or related services, you agree to these Terms and our Privacy Policy.
If you use the service on behalf of a company, trust, property owner, household, contractor, or other entity, you represent that you are authorized to do so.
Accounts and Access
Mountain Estates is an invite-only service. You are responsible for keeping your account credentials, devices, invite links, and login codes secure. You must promptly notify us if you believe your account has been compromised.
You may use the service only for authorized property management activities and only within the role, property access, and permissions assigned to you. We may update, suspend, or remove access where needed to protect the service, comply with agreements, or administer property relationships.
Service Use
You agree not to misuse the service. This includes not:
- accessing property, owner, contractor, invoice, document, or account information you are not authorized to access;
- submitting false, misleading, unlawful, harmful, or infringing information;
- interfering with service security, availability, authentication, or role-based access controls;
- copying, scraping, reverse engineering, or reselling the service except as allowed by law or written agreement;
- using the service to transmit malware, spam, abusive content, or unauthorized commercial messages.
User Content and Records
You may submit information such as property details, requests, notes, messages, photos, documents, signatures, approvals, invoices, and contractor or household contact details ("User Content"). You retain any rights you have in your User Content.
You grant Mountain Estates the right to host, process, display, transmit, and use User Content as needed to provide property management services, operate the app, maintain records, support users, comply with law, and enforce agreements. You represent that you have the rights and permissions needed to submit User Content to the service.
Communications and Notifications
By using the service, you agree to receive operational communications related to accounts, invitations, requests, inspections, maintenance, documents, invoices, security, and support. Communications may be sent by email, push notification, in-app message, phone, or text where configured and permitted.
You are responsible for keeping contact information current and for reviewing notices, approvals, tasks, and service records in a timely manner.
Invoices and Payments
The service may display invoices, proposals, approvals, service records, and payment-related status. Fees, reimbursement obligations, payment due dates, cancellation terms, and service-specific terms may be governed by separate management agreements, proposals, invoices, or written arrangements.
If a third-party payment processor is used, payment information may be handled by that processor under its own terms and privacy policy. Mountain Estates does not need full payment card numbers to operate the app.
Third-Party Services
The service may rely on third-party providers for hosting, database, authentication, storage, email, push notifications, mapping, documents, analytics, support, payments, and other infrastructure. We are not responsible for third-party services outside our control, and their terms may apply when you use them.
Availability and Changes
We may update, improve, suspend, or discontinue parts of the service at any time. We try to keep the service reliable, but availability may be affected by maintenance, internet conditions, third-party providers, emergencies, or events outside our control.
Disclaimers
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Mountain Estates disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and complete accuracy of information generated or displayed by the service.
The app supports property management workflows, but it does not replace professional judgment, emergency services, legal advice, insurance advice, inspection obligations, or written property management agreements.
Limitation of Liability
To the maximum extent permitted by law, Mountain Estates and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, service interruption, or unauthorized access, arising from or related to the service.
Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
Termination
You may stop using the service at any time. We may suspend or terminate access if we believe use violates these Terms, creates risk, is no longer authorized, or is otherwise inconsistent with applicable agreements or law. Certain records may be retained after access ends as described in our Privacy Policy and applicable contracts.
